Terms of Sale

This translation is provided for convenience. The French version is the legally binding one and prevails in case of any discrepancy: read it in French.

These terms of sale (the "Terms of Sale") apply to every order placed on MyBoost. They explain what you are buying, how the services are delivered and what your rights are.

1. Purpose and scope

The Terms of Sale govern the sale of the services offered under the trade name MyBoost on the websites www.getmyboost.com and myboost.fr (the "website"), between MyHub Solutions LLC ("MyBoost", "we", "us") and any person placing an order ("you", the "customer").

  • They apply to both consumer and business customers. Articles 8 (right of withdrawal) and 10 (statutory guarantee of conformity) concern consumers, meaning individuals acting for purposes outside their trade or profession.
  • You accept them when you confirm your order. The applicable version is the one in force on the date of the order; it is sent to you with the confirmation email and can be saved or printed.
  • Use of the website is governed by the terms of use. The affiliate program and the MyBoost Club are governed by their own terms, provided upon registration.
  • To place an order, you must be of legal age or have the consent of your legal representative.
  • The contract is concluded in the French language.

Emma is an artificial intelligence (AI) assistant. A team member can take over at your request.

3. Services

MyBoost offers growth services for social media: followers, likes, views, comments, listeners and other engagement, for Instagram, TikTok, YouTube, Facebook, Spotify, X, LinkedIn, Threads and Twitch.

  • At the time of the order, the page of each service states its main characteristics: platform, type and quantity of engagement, delivery pace and time frame, price and, where applicable, subscription frequency.
  • Depending on the service page, the service is offered as a one-time order or as a monthly subscription (article 7).
  • Engagement is delivered to the public profile or content you specify. We never ask for your password or for access to your account.
  • We undertake to deliver the quantity ordered within the stated time frame. However, the effect of that delivery on your visibility, audience, sales or income depends on external factors, including the platforms' rules and algorithms, and is not guaranteed.

4. Ordering

Steps

  • You choose the service and quantity, then enter the relevant username or public link.
  • You check the summary (service, quantity, link, price including taxes, frequency where applicable) and correct any errors.
  • You accept the Terms of Sale and expressly request that performance begin immediately (article 8).
  • You confirm the order, which entails an obligation to pay, and then you pay.

We then send you a confirmation email summarizing the order, your request for immediate performance and these Terms of Sale. It constitutes confirmation of the contract on a durable medium.

Information to check

  • The username or link is correct and corresponds to the right account or content.
  • The profile and content are public and online, and remain so throughout delivery.
  • The username is not changed during delivery.

If you notice an error, contact us as soon as possible. Before delivery starts, we correct it free of charge. If delivery has already started on an incorrect link that you provided, the part already delivered cannot be recovered and remains payable; the balance is delivered to the correct link or refunded, at your option.

We will never ask for your password. Do not share it with anyone, including anyone claiming to be MyBoost.

Refusal or cancellation by MyBoost

We may refuse or cancel an order only for a legitimate reason: payment declined, serious suspicion of fraud, content or use contrary to the law or to article 12, or the service having become unavailable. The sums paid for the part not performed are then refunded to you.

If payment fraud is suspected, we may ask you for verification limited to what is strictly necessary. If you do not respond within 60 days, the order is canceled and refunded.

5. Prices and payment

  • Prices are shown in the currency displayed on the website, including all taxes where taxes apply. For consumers in the European Union, they include VAT at the rate of the country of residence.
  • The applicable price is the one displayed when the order is confirmed. Any currency conversion fees charged by your bank remain your responsibility.
  • Payment is due upon ordering. It is made through Shopify's secure checkout, by bank card, PayPal, Apple Pay or Google Pay, depending on the methods offered at the time of payment. MyBoost does not have access to your full banking details.
  • For a subscription, the stored payment method is charged at the start of each period (article 7).
  • A receipt is sent to you by email.

6. Performance and time frames

  • Delivery starts automatically once payment is confirmed.
  • It is gradual: engagement is added in stages, at the pace shown on the service page.
  • The delivery time frame is the one shown on the service page at the time of the order and restated in the confirmation email. If no time frame is stated, the service is performed without undue delay and no later than 30 days after the contract is concluded (Code de la consommation (French Consumer Code), article L216-1).
  • The time frame is suspended for as long as delivery is made impossible by a cause beyond our control: profile or content switched to private or deleted, incorrect link, changed username. We notify you, and delivery resumes as soon as the situation is corrected.
  • You can track progress from your customer account, through Emma or by email. An email lets you know when delivery is complete.

Delay

If the service is not performed within the stated time frame, contact us: we will complete the delivery or, if you prefer, refund the part not performed. If you are a consumer, you may also, under the conditions of articles L216-6 et seq. of the Code de la consommation, ask us to perform the service within a reasonable additional period and, failing that, terminate the contract. The sums paid are then refunded no later than 14 days after termination.

Force majeure

If an event beyond our control, which could not reasonably have been foreseen or avoided, temporarily prevents performance, we will inform you and the time frame will be extended accordingly. If the impediment lasts more than 30 days, you may cancel the part not performed and obtain a refund for it.

7. Subscriptions

Subscribing

Some services are offered as a monthly subscription. Before you subscribe, the service page and the order summary state the content delivered each month, the monthly price including taxes, the date of the first charge and the automatic renewal until cancellation.

Renewal

  • The subscription has no minimum term: it renews automatically each month, on the anniversary date of the subscription, until it is canceled.
  • The price for each period is charged at the start of that period.
  • Where required by applicable law, we inform you by email, before renewal, that you may choose not to continue.
  • Any change to the price or content of the subscription is announced to you by email at least 30 days before it takes effect. You may cancel free of charge before that date.

Cancellation in a few clicks

  • You may cancel at any time, free of charge and without giving a reason, from your customer account using the "Cancel your contract" function, in a few clicks, in accordance with article L215-1-1 of the Code de la consommation. You may also cancel by email at contact@myboost.fr or through Emma.
  • An email confirms the cancellation and the date on which it takes effect.
  • Cancellation takes effect at the end of the current period, which has already been paid: deliveries for that period continue and no further charge is made.
  • If a renewal is charged after your cancellation request has been received, it is refunded to you.
  • After cancellation, the drop-protection guarantee (article 9) continues to apply to engagement already delivered.

During the 14 days following the subscription, you also have the right of withdrawal (article 8).

8. Right of withdrawal

Time limit

If you are a consumer, you have 14 days from the conclusion of the contract (the date of the order or of the subscription) to withdraw, without having to give reasons for your decision (Code de la consommation (French Consumer Code), articles L221-18 et seq.). You simply need to send your statement before this period expires.

Immediate performance and loss of the right of withdrawal

Our services begin as soon as payment is made. When you order, we therefore ask you:

  • to expressly request that performance begin before the end of the withdrawal period;
  • to acknowledge that you will lose your right of withdrawal once the service has been fully performed.

Consequences:

  • Service fully performed before your withdrawal: the right of withdrawal can no longer be exercised (article L221-28, 1°).
  • Service being performed: you may withdraw. You pay only an amount proportionate to what has been provided until you communicated your decision; the remainder is refunded to you (article L221-25). For a subscription, this amount is calculated on the current period.
  • No express request obtained: if we did not obtain your request for immediate performance, no amount is payable for the part performed during the withdrawal period.

How to withdraw

  • Online, using the "Withdraw from the contract here" function at the end of this article, available throughout the withdrawal period (article L221-21 of the Code de la consommation): enter your first and last name, your email address and the order number, then confirm sending.
  • By email to contact@myboost.fr or by mail to the address given in article 2, using the model form below or any other unequivocal statement.
  • Through Emma, clearly stating that you are withdrawing and giving the order number.

We will send you, as soon as possible, an acknowledgment of receipt by email setting out the content of your statement and the date and time it was sent.

Refund

We refund all sums paid, less, where applicable, the proportionate amount stated above, without undue delay and no later than 14 days after being informed of your decision (article L221-24 of the Code de la consommation). The refund is made using the payment method used for the order, unless you expressly agree to another method, and at no cost to you.

9. Lifetime drop-protection guarantee and free refill

Refills are free, and the drop-protection guarantee is free and lifetime.

Platforms may at any time remove followers, likes, views or other engagement that they consider inauthentic. That is the reason for this guarantee.

What the guarantee covers

  • Any drop in the followers, likes, views, comments, listeners or other engagement delivered by an order.
  • We deliver the lost quantity again (the "refill"), up to the quantity delivered by the order.
  • Refills are free, with no monthly cap and no limit on the number of requests.
  • "Lifetime" means for as long as the MyBoost service is operated, including after the end of a subscription for engagement already delivered.
  • The guarantee applies to one-time orders and to each delivery under a subscription.

How to request it

From your customer account, through Emma or by email to contact@myboost.fr, stating the order number and, if possible, the link concerned. We verify the drop using the public data of the profile or content.

Processing time

We process your request and start the refill within 72 hours. The refill is then delivered gradually, within a time frame that does not exceed the one stated for the original order.

Conditions required for a refill

These conditions do not limit the guarantee: they are simply necessary for the refill to be delivered.

  • The profile or content concerned is public and still online.
  • The username or link is the same as in the order. If you have changed it, give us the new one: we will check that it is the same account or content.
  • The account has not been deleted or suspended by the platform.
  • The content concerned (post, video, track…) has not been deleted.

If any of these conditions is no longer met, the guarantee is merely suspended: it applies again as soon as the condition is restored, for example when the profile becomes public again.

Statutory guarantees

This guarantee is in addition to your statutory rights. It does not reduce or replace the statutory guarantee of conformity (article 10), the right of withdrawal (article 8) or any other right you have under the law.

10. Statutory guarantees of conformity

If you are a consumer, you benefit from the statutory guarantee of conformity applicable to digital services (Code de la consommation (French Consumer Code), articles L224-25-12 et seq.). No clause of these Terms of Sale limits or excludes it.

Duration

  • One-time order: we are liable for any lack of conformity that exists at the time of supply and becomes apparent within two years of supply.
  • Subscription (continuous supply): we are liable for any lack of conformity that becomes apparent throughout the period of supply provided for in the contract.

Your rights

  • To have the service brought into conformity, free of charge, without undue delay and without significant inconvenience to you.
  • Failing that (conformity refused, impossible, late or ineffective), to obtain a price reduction or terminate the contract. Termination is not possible if the lack of conformity is minor.
  • In the event of a price reduction or termination, to be refunded without undue delay and within 14 days at the latest, using the payment method used and at no cost.

How to invoke it

Contact us by email at contact@myboost.fr, through Emma or from your customer account, stating the order number and the defect observed. This guarantee applies independently of the drop-protection guarantee (article 9).

Business customers benefit from the guarantees provided by applicable law as well as from the drop-protection guarantee (article 9).

11. Refunds

The cases and terms of refunds are detailed in the refund policy, which applies these Terms of Sale. In summary, you are refunded:

  • in the event of withdrawal (article 8);
  • if the service is not performed, or not fully performed, within the stated time frame (article 6);
  • in the event of a lack of conformity giving rise to a price reduction or termination (article 10);
  • in the event of a duplicate payment or billing error;
  • if a subscription renewal is charged after your cancellation request (article 7).

Refunds are made using the payment method used, at no cost, no later than 14 days after the refund is accepted or your withdrawal is received. A drop in engagement after delivery gives rise to a free refill (article 9).

12. Customer obligations and platforms

Your commitments

  • To provide accurate information and to order for a profile or content that you own or for which you are authorized.
  • Not to use the services for unlawful purposes: identity theft, fraud, hateful or unlawful content, or content infringing the rights of third parties.
  • Not to use the services to mislead consumers, in particular by presenting purchased engagement as evidence of the quality or popularity of products or services you sell.

In the event of a breach, we may refuse or suspend the order concerned after informing you. The part not performed is refunded to you.

Platforms

  • MyBoost is an independent service. It is not affiliated with, endorsed by or sponsored by Instagram, Facebook, Threads or Meta, TikTok, YouTube or Google, Spotify, X, LinkedIn or Twitch. Their trademarks belong to their respective owners.
  • Each platform has its own terms of use, which may prohibit or regulate obtaining engagement through third-party services. It is your responsibility to comply with them.
  • Platforms may remove engagement they consider inauthentic, limit the visibility of content or restrict an account. These decisions are not within MyBoost's control. The drop-protection guarantee (article 9) covers the loss of delivered engagement.

13. Liability

  • We are responsible for the proper performance of the services ordered, under the conditions provided for by law.
  • We cannot be held liable where the damage results from inaccurate information you provided, from use contrary to article 12, from a platform decision that does not result from a failure on our part, or from force majeure.
  • For business customers, our liability is limited to the amount paid for the order concerned and excludes indirect damage, such as loss of revenue, except in the event of gross negligence or willful misconduct.
  • For consumers, no clause of the Terms of Sale has the effect of excluding or limiting the rights granted to them by mandatory provisions of law.

14. Personal data

MyHub Solutions LLC processes the data needed for the order (identity, email address, username or public link, order and payment information, communications with customer service) in order to perform the contract, provide the drop-protection guarantee, prevent fraud and comply with its legal obligations. Communications with Emma are processed by an artificial intelligence tool. We never ask for your passwords.

For a complaint, provide your order number and describe the problem. We will reply as soon as possible.

16. Governing law and disputes

  • The Terms of Sale are governed by the laws of the State of Wyoming (United States).
  • If you are a consumer, this choice cannot deprive you of the protection afforded to you by the mandatory provisions of the law of your country of habitual residence (article 6 of Regulation (EC) No 593/2008, known as "Rome I").
  • If a problem arises, we invite you to write to us first at contact@myboost.fr so that we can seek an amicable solution together. This step does not prevent you from taking legal action.
  • You may also use any mediation or amicable dispute resolution scheme, or refer the matter to any competent authority, available in your country.
  • If you are a consumer domiciled in the European Union, you may bring proceedings before the courts of your domicile, and we may only bring proceedings against you before those courts (article 18 of Regulation (EU) No 1215/2012, known as "Brussels I bis").
  • For business customers, the courts of the State of Wyoming have jurisdiction, subject to applicable mandatory rules.

17. Changes to the Terms of Sale

We may update the Terms of Sale, for example to reflect a change in the law or in our services. The date of the last update appears at the top of this page, and each order remains governed by the version in force on its date.

For an ongoing subscription, any change is notified to you by email at least 30 days before it takes effect. If you do not accept it, you may cancel free of charge before that date.

18. Customer reviews

The customer ratings and reviews we display come from Trustpilot, an independent review platform. In accordance with article L111-7-2 of the Code de la consommation (French Consumer Code), here is how these reviews are collected, processed and displayed.

Collection

  • Reviews are posted directly on Trustpilot by people who have had an experience with MyBoost. We may invite our customers to post one after an order, without any incentive and regardless of whether their review is positive or negative.
  • We do not pay for any review, and we do not write or have anyone write any review. You are free to publish a review or not, and to edit or remove it on Trustpilot.

Display

  • When the website displays reviews, they are a selection of reviews published publicly on Trustpilot, reproduced without modification, with the rating and author name as shown there.
  • The overall rating (TrustScore) shown on the website covers all reviews received on Trustpilot, favorable and unfavorable alike, as of its last update. MyBoost's Trustpilot page shows all reviews, their ratings and their dates at any time.
  • We do not remove unfavorable reviews, and we do not select the reviews displayed in order to conceal them. We may reply publicly to a review.

Moderation and authenticity

  • Trustpilot applies its own rules for publication, verification and fake-review detection. MyBoost carries out no prior review or moderation of these reviews. We may report to Trustpilot a review whose authenticity seems doubtful to us; the decision rests with Trustpilot.
  • We do not claim that every review displayed comes from a person who actually purchased the service: verification is a matter for Trustpilot's procedures, described on its website.
  • It is prohibited, including for affiliates and partners, to publish or have published fake reviews or to misrepresent existing reviews. These practices are considered misleading in all circumstances (Code de la consommation, article L121-4, 27° and 28°, derived from Directive (EU) 2019/2161, known as the "Omnibus" Directive, which inserted points 23b and 23c into Annex I of Directive 2005/29/EC).
